What you will do:

This role will provide direction and support toward the implementation of Wacker’s corporate-wide Customs and Trade Compliance program. The Customs and Trade Compliance Division is tasked with global corporate alignment, education, training, program development, implementation, maintenance, and audit thereof, along with the monitoring of regulations in the following “five” key areas to which Wacker is voluntarily or “legally bound” under Federal law.

 

  1. Customs Compliance including Free Trade Agreements
  2. Export Control
  3. Trade Compliance
  4. CTPAT Supply Chain Security
  5. Foreign Trade Zones

 

The Customs & Trade Compliance Agent will assist in the drafting of written directives, internal policies and procedures, and their corporate-wide implementation, in alignment with Wacker Chemie AG and multiple Federal Agencies.  Such procedures and policies will be maintained as appropriate in Wacker’s IMS Library. This role will provide required trainings and updates as regulations change, departmental compliance monitoring, audit, and performance measurement thereof. Trainings will be integrated within Wacker’s Learning Solutions Management System (LSO), with appropriate trainings scheduled for all relevant departments and/or individuals. In addition, this person will work with legal and others to ensure Wacker’s Trade compliance policy language where appropriate, are included in Contracts for suppliers and customers.

 

Corporate-wide Customs and Trade Compliance implementation will include:

 

Customs Compliance (40%)

  • Uyghur Forced Labor Prevention Act ULFPA - Implementation of the ULFPA requiring Wacker to have a compliance program in place to prevent Forced Labor, by working with Wacker Procurement and others to ensure compliance from the sourcing of raw materials to assembly to ultimate consignee.
  • Free Trade Agreements-FTA’s - Written compliance procedures to accurately and timely process the United States more than 20 bilateral Free Trade Agreements including USMCA used by over 100 Wacker Customers.
  • Country of Origin-CoO – Work with Process Chemists, Chemists of Record, Technical Managers, Material Coordinators, Supply Chain, SAP Master Data Coordinators and Procurement and Supply Chain personnel to implement Country of Origin policies and procedures and determinations for Wacker products and materials in Wacker’s MAF system on a corporate wide basis.

 

Export Control (30%)

  • Implement a corporate wide Export Control program in alignment with US laws and regulations and Wacker Chemie, AG. To include:
  • Know Your Customer-KYC Implementation of due diligence processes to determine if red flags exist for imports, exports, reexports or transfer in-country products and materials being sold.  Work with Chemist, Sales department, sales agents and customers to evaluate both new and existing transactions including but not limited to end-use, end users and countries Wacker exports to.
  • ECCN & Export Classification utilizing knowledge of chemical science, this person will assist in the audit and classification of Wacker Exports for purposes of Export Control compliance essential in determining whether an export license is needed from the Department of Commerce.

 

Trade Compliance (20%)

The successful candidate will be responsible for the implementation of trainings, responding to internal inquiries, audit, and development of compliance measurements for the many trade compliance regulations of PGA’s (Partner Government Agencies) of which Wacker is required under law: Including:

  • The Office of the US Trade Representative i.e., FTA’s, Section 301
  • US International Trade Commission i.e., AD/CD, Miscellaneous Tariff Bill
  • US Drug Enforcement Administration i.e., Recordkeeping for List II Chemicals
  • US Environmental Protection Agency i.e.,
  • US Food and Drug Administration
  • US International Trade Administration
  • US Federal Trade Commission

 

CTPAT Supply Chain Security (5%)

  • The Customs & Trade Compliance Administrative Agent will assist in the on-going implementation of Customs Trade Partnership Against Terrorism program for all Wacker sites.  Such administration will seek to ensure Wacker is compliant with CTPAT’s Minimum Security Criteria which now includes Forced Labor compliance.

 

Foreign Trade Zones-FTZ (5%)

  • Wacker operates (2) two FTZ’s.  The person selected for this position will be trained to administer the day-to-day operations of the Foreign Trade Zone located in Charleston, Tennessee and serve as backup for Wacker’s Adrian FTZ site.  Because of volume, it is expected that the workload will only involve only a quarter of this person’s time, with the remainder being spent on Customs and Trade Compliance matters.

 

What we need from you:

  • Bachelor’s degree required, or equivalent experience; Master’s degree preferred
  • Familiarity with chemical products, materials including CAS numbers and chemical descriptions
  • Experience in both US and Foreign trade compliance
  • 5+ years of work experience, preferably in a global manufacturing company
  • Strong verbal and written communication skills
  • Strong chemical/science knowledge and background
  • SAP, MS Word, Excel, PowerPoint, and other technical software systems
  • Must have the ability to write and implement policies and procedures
  • Broad understanding of global business and matrix organizations
